Parties and subject matter
1.1. The aiana.tech website belongs to AIANA Limited Liability Company (INN 9725206541, address: 115432, Russia, Moscow, proezd Proyektiruemyy 4062-y 6, room 24A/5, bldg 1), hereinafter AIANA.
1.2. These terms govern the relationship between AIANA and any person using the site, hereinafter the user.
1.3. The terms apply to all sections of the site, including research pages, their machine-readable versions and service files. Paid access is additionally governed by the agreement concluded with the subscriber; in the event of a discrepancy, that agreement prevails.
1.4. The current version is published at aiana.tech/legal/terms/.
Definitions
- Materials — research reports, analytical notes, texts, tables, charts, diagrams, maps, illustrations, datasets, interface source code and the design of the site.
- Open version — materials published for free access, first of all the open version of the RAI-2026 research.
- Gated materials — the full version of the research, the company registry, machine-readable datasets, segment editions and the AIANA platform, access to which is granted under a contract.
- Registry — a systematized body of information about organizations participating in the artificial intelligence market, together with AIANA's calculated indicators.
Rights in the materials
3.1. Exclusive rights in the materials belong to AIANA. The materials are protected as:
- works of science and literature, including graphic works and derivative works (Article 1259 of the Civil Code of the Russian Federation);
- a compilation — by the selection and arrangement of the materials (Article 1260 of the Civil Code);
- a database — as regards the registry and the datasets, the database maker's rights in the extraction of materials and their subsequent use (Articles 1333–1336 of the Civil Code).
3.2. The AIANA registry contains more than ten thousand independent items of information, which under the second paragraph of clause 1 of Article 1334 of the Civil Code creates a presumption of substantial financial, material and organizational investment in its creation. Extraction and subsequent use of a substantial part of the registry without AIANA's consent is not permitted.
3.3. The materials may be used only in the ways expressly permitted by these terms, by the licence of the open version, or by a separate written agreement with AIANA.
3.4. The designation “AIANA”, the logo and the visual identity are AIANA's means of individualization. They may be used solely to identify AIANA as the source of the information, and must not create the impression of partnership with, endorsement by, or participation of AIANA in someone else's project.
The open version: what you may do
4.1. The open version of the research is distributed under the CC BY 4.0 licence. The materials may be freely copied, published, translated, adapted and used for commercial purposes, provided AIANA is credited as the source and an active hyperlink is included.
4.2. The full rules and ready-made attribution wordings are on the “Licence and citation” page. That page forms an integral part of these terms.
4.3. Quotation for informational, academic, polemical and critical purposes is also permitted under Article 1274 of the Civil Code — to the extent justified by the purpose, with mandatory attribution to the source.
Gated materials
5.1. Access to gated materials is granted under a contract to a named person or to a limited group of employees of a subscribing organization.
5.2. The authorization mechanisms restricting access to gated materials are technical means of copyright protection within the meaning of Article 1299 of the Civil Code. Circumventing them, as well as producing and distributing means of circumvention, is prohibited by law regardless of whether an infringement of the exclusive right subsequently occurred.
5.3. The information contained in the gated materials — in particular the methodology for assigning the AI-ization coefficient (K-AI), the values of that coefficient for individual organizations, primary calculation data and the parameters of the forecasting model — has been classified by AIANA as a trade secret under Federal Law No. 98-FZ of 29 July 2004. Media carrying such information bear the corresponding marking.
5.4. Obtaining gated materials against AIANA's will, disclosing them, or using them by a person who knew or ought to have known that they were obtained unlawfully, entails liability under Article 14 of Law No. 98-FZ and Article 183 of the Criminal Code of the Russian Federation.
5.5. Copies of gated materials carry individual markers that identify the recipient. Access to gated sections is logged.
Prohibited actions
When using the site it is prohibited to:
- circumvent or attempt to circumvent authorization mechanisms and other technical protection measures, or pass issued credentials to third parties;
- carry out automated collection of site data (scraping, crawling, parsing) beyond the limits set by the robots.txt file, or generate load that differs from ordinary user behaviour;
- extract a substantial part of the registry or of the datasets, including by repeated extraction of insubstantial parts;
- reproduce the materials under someone else's name, or remove or alter attributions of authorship, copyright notices and licence information;
- use the materials in a way that creates a false impression of endorsement, partnership or participation by AIANA;
- distort AIANA data when reproducing it — quoting an indicator without the methodological caveat that accompanies it, where this changes the meaning, or attributing to AIANA conclusions that are not in the materials;
- disrupt the operation of the site, attempt unauthorized access, or introduce malicious code;
- use the materials for actions contrary to the legislation of the Russian Federation.
AIANA may restrict access to the site from addresses used for any of the above without prior notice.
Nature of the information published
7.1. AIANA materials are informational and analytical in nature. A significant part of the indicators published are AIANA's calculated estimates and value judgements, produced under the methodology described in the research — not reported figures of the organizations concerned, and not information confirmed by those organizations.
7.2. In particular, the following are estimates: the share of an organization's revenue attributed to artificial intelligence (the K-AI coefficient), the assignment of an organization to a segment and sub-segment of the taxonomy, the allocation of revenue between segments, the size of segments and of the market as a whole, and any forecast values.
7.3. Forecasts and scenario calculations rest on assumptions valid as at the date of publication. Actual results may differ materially. AIANA assumes no obligation to update forecasts as circumstances change.
7.4. The materials do not constitute:
- individual investment advice within the meaning of Federal Law No. 39-FZ of 22 April 1996 “On the Securities Market”; AIANA is not an investment adviser and is not entered in the corresponding register of the Bank of Russia;
- an offer to enter into a contract in respect of any securities, shares or assets;
- an audit opinion, a valuation within the meaning of Federal Law No. 135-FZ of 29 July 1998 “On Valuation Activities”, or an expert report;
- legal, tax or accounting advice;
- advertising of specific goods, works, services or organizations.
7.5. Decisions taken on the basis of the materials are taken by the user independently and at the user's own risk.
7.6. The mention of an organization in the materials does not amount to an assessment of it as good or bad, reliable or unreliable; the order in which organizations are listed is not a ranking unless expressly stated.
Information about organizations and how it is corrected
8.1. Information about organizations is obtained from publicly available sources — the state information resource of accounting (financial) statements, the registries of the Federal Tax Service of Russia, public reporting and official announcements by the organizations themselves — and processed under the methodology described in the research.
8.2. AIANA has an interest in accuracy and considers requests from organizations to correct information relating to them. The procedure:
- send the request to hi@aiana.tech with the subject line “Data correction”, stating the organization, its INN, the disputed indicator and the grounds;
- AIANA reviews the request and replies on the merits within 10 business days;
- where an inaccuracy is confirmed, the information is corrected within 5 business days of the date of the reply, and a dated correction note is added to the material;
- where the difference is caused by differing methodologies rather than by an error, AIANA will, at the organization's request, publish its position alongside the indicator, in up to 500 characters.
8.3. This procedure is the preferred way of resolving disagreements about the content of the materials and does not deprive an organization of its right to protect its business reputation by the means established by law.
8.4. An organization may require the removal from published open materials of information that it has classified as a secret protected by law and that ended up in the materials by mistake. Such a request is considered within the period stated in clause 8.2.
Personal data
The processing of users' personal data, including data submitted through the forms and web analytics data, is carried out in accordance with the Personal Data Processing Policy.
Third-party materials and third-party trademarks
10.1. The materials use information and software components of third parties. Their list, rights holders and terms of use are set out on the third-party materials page.
10.2. Organization names, trademarks and service marks mentioned in the materials belong to their respective rights holders and are used solely for informational purposes — to identify the person concerned. Such use is not intended to individualize AIANA's goods, works or services and does not imply any connection with the rights holder.
10.3. The site contains links to external resources. AIANA does not control their content and is not responsible for it.
Operation of the site
11.1. The site is provided “as is”. AIANA does not warrant uninterrupted operation, the absence of errors in the materials, or fitness for the user's particular purposes.
11.2. AIANA may at any time change the composition and content of the materials, suspend the site for maintenance and discontinue the publication of individual materials. This clause does not override the irrevocability of the CC BY 4.0 licence in respect of an open version already published: withdrawing a material from publication does not terminate the rights of those who obtained it earlier.
11.3. Obligations towards subscribers to gated materials are determined by the contracts concluded with them and are not limited by this section.
Liability
12.1. AIANA is not liable for losses arising from the use of, or inability to use, the materials, including lost profit and the consequences of decisions taken on their basis, except in cases of AIANA's intent or gross negligence.
12.2. A user who breaches these terms or AIANA's rights bears liability under the legislation of the Russian Federation. AIANA may claim damages or statutory compensation under Articles 1301 and 1311 of the Civil Code, and seek the measures provided for by Articles 1252 and 1299 of the Civil Code.
12.3. If a user's actions result in third-party claims against AIANA, the user shall reimburse AIANA for the related costs.
Claims and dispute resolution
13.1. The relationship between the parties is governed by the law of the Russian Federation.
13.2. Before going to court, a party shall send a written claim to hi@aiana.tech or to AIANA's postal address. The period for replying to a claim is 15 business days from receipt.
13.3. Disputes not settled through the claim procedure are heard by the Arbitration Court of the city of Moscow or, where the dispute falls outside the competence of an arbitration court, by the court at AIANA's location, unless exclusive jurisdiction is established by law.
13.4. Notices are deemed received on the business day following dispatch to the email address stated by the party, or on the seventh day after a postal item is sent.
Changes to these terms
AIANA may amend these terms. A new version takes effect when it is published on this page. The version date is stated at the top of the document. Continued use of the site after a new version is published means acceptance of it. Changes have no retroactive effect and do not affect rights already granted under the CC BY 4.0 licence or under concluded contracts.
